Open Carry in Texas

We have had a few questions on Open Carry and resources available for ReStores and Affiliates.

Texas C-Bar has developed this resource for nonprofits, including signage.

The Texas Retailers Association is also providing information and free, downloadable signs. Click here. This site has information on concealed weapons and open carry, but don’t get confused because there is also information from the Texas Alcoholic Beverage Commission for restaurants and bars….skip that session and those signs, of course. Below is the information that ReStores need to know from the TRA website:

Open/Carry Laws information:

Employers should notify their employees of the store’s policy on whether or not open carry is allowed by both customers and employees. The law does not prevent or otherwise limit the right of a public or private employer to prohibit employees from carrying a handgun on the premises of the business.

If you choose to allow open carry, all employees should be notified of this choice and made aware of the legal requirements for an individual who openly carries a handgun.http://www.dps.texas.gov/RSD/CHL/faqs/index.htm

If you choose not to allow open carry, all employees should be notified of this choice and the specific company policy for notifying the public. There are three ways in which you may notify the public that open carry is not allowed in your stores.

Post a 30.07 sign that must follow these legal criteria:
• Appear in contrasting colors with block letters at least one inch in height; and
• Include the following text in English and in Spanish:
o Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Sub chapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a handgun that is carried openly.
o Conforme a la sección 30.07 del Código Penal (Traspasar portando pistolas abiertamente) personas con licencia bajo del Sub-Capitulo H, Capítulo 411, Código de Gobierno (Ley de Portar Pistolas), no puede ingresar a esta propiedad portando una pistola abiertamente.
• Be displayed in a conspicuous manner clearly visible to the public at each entrance to the property
